Impeach Ragsdale...No, Reilly!

Our only question is, What the hell is the Senate waiting for?

Three elections positions are currently vacant, one more than what started the ball rolling on former president Sarah Ragsdale's impeachment. No president will take elections seriously until there are real consequences for failing to do one's duty. And this time, the circumstances are much, much worse. Reilly is running for reelection, and therefore arguably benefits from a bungled election. Being the chief executive doesn't hurt, but it shouldn't allow you unfair advantages.

In what is probably a vain effort to wake the Senate out of its session-long slumber, we have done the hard work of drafting an impeachment resolution, included below. Senators, any senator, feel free to use it. We beg you.

Impeaching Sarah M. RagsdaleEli M. Reilly, President of the Associated Students, for malfeasance or the failure to discharge the powers and duties of office.


Resolved, That Sarah M. RagsdaleEli M. Reilly, President of the Associated Students, is impeached for malfeasance or the failure to discharge the powers and duties of office, and that the following articles of impeachment be exhibited:


Articles of impeachment exhibited by the Senate of the Associated Students, in the name of itself and of the members of the Associated Students of the University of Nevada, against Sarah M. RagsdaleEli M. Reilly, President of the Associated Students, in maintenance and support of its impeachment against herhis for malfeasance or the failure to discharge the powers and duties of office.


Article I


In herhis conduct while President of the Associated Students, in violation of herhis constitutional oath faithfully to execute the office of President of the Associated Students and, to the best of herhis ability, to preserve and protect the Constitution of the Associated Students, and in violation of herhis constitutional duty to take care that the laws be faithfully executed, has impeded the elections process of the Associated Students, in that:


Sarah M. RagsdaleEli M. Reilly neglected to appoint, in a timely manner, members to the Commission on Association Elections, as the Senate has lawfully provided for in An Act entitled “To provide for the creation and duties of a Com-mission on Elections” and in An Act entitled “To establish a Code of Elections governing the conduct of Association elections”, and by such conduct has impeded the elections process of the Association by leaving offices unfilled which, in the judgment of the Senate, are necessary for the efficient management and execution of elections.


In all of this, Sarah M. RagsdaleEli M. Reilly has undermined the integrity of herhis office, has brought disrepute on the Presidency, has betrayed herhis trust as President, and has acted in a manner subversive to the rule of law and justice, to the manifest injury of the members of the Associated Students.


Wherefore, Sarah M. RagsdaleEli M. Reilly, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust, or profit under the Associated Students.

  2. What I find sad/funny about this is that I went to my representatives after the election and * begged * them to have the Election's board seated before Spring semester.

    And I don't really want to hear about how this is Eli's fault. The Senate should have stomped on his feet until he moved forward.

    You're right, the Senate is not blameless in this. Problem is this is two years in a row that the president has treated elections like a joke.

  4. But maybe, if two years in a row the president cannot fill these positions there is a problem with the mandating the positions. First, if the current elections commissioner can do the task himself with JCSU staff and doesn't need a commissioner, well that saves ASUN money. Further, its not a glamorous position with a great title and it doesn't pay very much, and who would want that position with open justice seats? I think we need to know *why* the positions can't be filled, is it because no one is applying or wants the positions, because that warrants a change in the laws, or if its just Eli not trying or being overly picky, well, thats him neglecting his duties. The debate isn't as cut and dry as you'd like to make it, in my opinion.

    No, it is not that simple. Rarely anything is. The point is the Senate presumably came to the reasoned conclusion that these officials were necessary to ensure a well-run election. The five lead officials each have distinct roles that don't seem like rocket science. Have you even read the Election Code? Start with section 2(a), then skip to section 3. Then read section 5 on staffing the polls.

    Glamorous, no. Not much pay? Perhaps. The Elections Compensation Act of 2007 grants the vacant positions $600 in compensation. For how much real work, it's anyone's guess.

    I agree with you. Here's another possibility. Does nobody want them, or has the search for candidates been ineffective? With a downturned economy, $600 for a student for a couple of months worth of work isn't entirely bad.

    Eli Reilly abandoned the will of the students of the University of Nevada in their passage of the ASUN Constitutional Amendment 75-45; where under the ASUN Public Law 75-40 the President has an obligation to “ensure the expeditious consideration of the amendment by the Board of Regents of the Nevada System of Higher Education,” where under the ASUN Constitution, Section V an amendment is only valid with “assent by the Board of Regents of the Nevada System of Higher Education.”
    Article III
    In his conduct while President of the Associated Students, in violation of his constitutional oath faithfully to execute the office of the President of the Associated Students and, to the best of his ability, to preserve and protect the Constitution of the Associated Students, and in violation of his constitutional duty to take care that he laws be faithfully executed, has failed to make all appointments to University Committees, in that:
    Eli Reilly deserted the Students of the University of Nevada in failing to appoint representatives to all University Committees which ensure that in these times of a budgetary crisis a student voice is heard at every level of this university under the provisions of the Executive Branch Act of 2007.
    Article IV
    In his conduct while President of the Associated Students, in violation of his constitutional oath faithfully to execute the office of the President of the Associated Students and, to the best of his ability, to preserve and protect the Constitution of the Associated Students, and in violation of his constitutional duty to take care that the laws be faithfully executed, has used his position as President to protect his status, in that:
    Eli Reilly has undermined the integrity of his office, has brought disrepute on the Presidency, has betrayed his trust as President, and has acted in a manner subversive to the rule of law and justice, to the manifest injury of the members of the Associated Students. Further with the content of the Constitutional Amendment 74-45 dealing with additional cases for impeachment under the definition of Misfeasance of “performance of a legal act in an improper manner” and Nonfeasance of “failure to perform an act which ought to be done; or the failure to perform the powers and duties of office” Eli M. Reilly has protected himself from his earlier transgressions and potential calls for impeachment.

    Wherefore, Eli Reilly, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust, or profit under the Associated Students.

    I have read the elections code. I'm just pointing out that there are other factors to look at here instead of just jumping straight ahead to impeachment. I am not a Reilly fan at all, but making quick judgments as suggested in this blog are not always the best way to go about things. I think a huge problem might me the advertising, you made a great point that during the economic climate, people should be jumping at this opportunity, I do know that its been advertising on the asun website, but further than that -- it seems like there hasn't been any advertising.

  8. I guess none of you have chosen to attend senate meetings recently.....

    If you were ACTUALLY involved you would hear Sean Driscoll, the Elections Commissioner and officer responsible fore filling the positions, telling the Senate on a weekly basis that he and Eli are trying very hard to find individuals to fill these positions but that no one wants them because they are either (A) applying for another position (Justice seats are open, and are 2 year appointments)of (B) don't have the time. Sean has asked repeatedly for the help of the Senators in encouraging qualified individuals to apply every week in Senate meetings.

    And elections positions are not the only ones with a void of applicants. Perhaps you should stop spouting nonesense and slander, really get the facts on the issue and then make an objective response that provides SOLUTIONS.

    Oh, and if you are going to blame someone (which I really don't think is nescessary), blame the entire student body! THEY are the apathetic slugs who choose not to participate....in anything.

    All this blog seems to be here for is to bash on candidates who [insert name of gripy queen who is dating the current VP here] doesn't like or disagrees with.
